Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy supplements our Privacy Policy and governs consumer health data as defined by the Washington My Health My Data Act and the similar Nevada and Connecticut laws. Where it conflicts with the general Privacy Policy on consumer health data, this policy controls.

Not a HIPAA Covered Entity

NOWISLIFE is a consumer fitness app, not a healthcare provider, health plan, or clearinghouse. We are not a "covered entity" or "business associate," and HIPAA does not apply to the data you give us. Your health data is protected instead by this policy and by consumer-health-data laws.

Consumer Health Data We Collect

• Apple HealthKit metrics — heart rate, resting heart rate, heart rate variability (HRV), sleep duration, steps, active calories, and workouts (including workouts you record outside NOWISLIFE). To power coaching we store summaries of certain Apple Health data on our servers — such as a daily recovery summary and summaries of outside workouts; other metrics stay on your device.
• Raw Apple Watch motion-sensor data (accelerometer, gyroscope, device-motion) that you optionally contribute to improve our tracking
• Fitness and workout data you log in the app
• Inferences we derive for coaching, such as recovery or readiness assessments

Sources

We collect this data directly from you and from your devices (iPhone and Apple Watch, via Apple HealthKit), only with your separate, affirmative consent.

Why We Collect It

To provide workout tracking, generate your recovery-aware coaching insights, and train and improve our own automatic set- and rep-tracking. Never for advertising, marketing, profiling for ads, or any unrelated purpose.

How It's Handled

We do not share your consumer health data with any independent third party for its own use. The only entities that process it are our own service providers, under contract, acting solely on our behalf to run these features.

We Do Not Sell It

We do not sell your consumer health data, we have no plans to, and nothing in this policy or your consent authorizes us to.

No Location Tracking

We do not collect your location and do not use geofencing.

Your Rights

• Consent and withdraw — collection requires your separate, affirmative consent, which you can withdraw at any time in Settings. Withdrawing stops collection and deletes the data you contributed.
• Confirm and access — confirm whether we collect, share, or sell your consumer health data, and access it
• Delete — request deletion; we delete it from our records and direct our service providers to delete it too
• Non-discrimination — we will not deny service or charge you differently for exercising these rights

To exercise these rights, contact us at nowislife.com/contact. We respond within 45 days (extendable once where allowed). If we deny a request, you may appeal by replying to our response; if the appeal is denied, you may contact your state Attorney General.

Retention

We keep server-stored consumer health data only as long as needed and no longer than 24 months, and we delete it when you disconnect, withdraw consent, or delete your account.

Coverage

These protections apply to residents of Washington, Nevada, and Connecticut, and we extend them to all NOWISLIFE users who use our health or fitness features.
