Terms of Service

Eligibility

You must be at least 18 years old to create an account or use NOWISLIFE. During registration you must separately confirm that you meet this age requirement. If we learn that a user is under 18, we will terminate the account.

Your Account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You may register one account per person. You may optionally register a passkey (Face ID, Touch ID, or device PIN) for passwordless login; your biometric data never leaves your device and is never transmitted to our servers. The app tracks your daily workout streaks (consecutive days you complete your routine) as a motivational metric. Streak data is part of your account and may be affected by account changes or service interruptions. Pseudonymous analytics data is collected to help us improve the service (see our Privacy Policy for details).

Health, Fitness & Assumption of Risk

NOWISLIFE is a workout tracking tool, not a medical service, and nothing in the app is medical advice, diagnosis, or treatment. The AI Coach, the daily Today message, the optional Workout Debt feature, and any recovery or readiness prompts are motivational and informational only. They are not clinical guidance, and you should not rely on them in place of a qualified professional.

Consult a physician first. Talk to a qualified healthcare professional before you start, change, or stop any exercise program — especially if you have a medical condition, are pregnant, are recovering from injury, or have any doubt about your fitness to exercise.

You represent that you are healthy enough to exercise. By using NOWISLIFE you represent that you are physically able to perform physical activity and that no healthcare professional has advised you otherwise.

Listen to your body. Stop immediately and seek medical attention if you feel faint, dizzy, short of breath, or any pain or discomfort.

Assumption of risk. Exercise carries inherent risks — including muscle strains, sprains, fractures, cardiac events, and, in rare cases, serious or fatal injury — and those risks can arise even when you follow suggestions generated by NOWISLIFE or its AI Coach. You knowingly and voluntarily assume all risk of injury, illness, death, or loss arising from your use of NOWISLIFE and from any physical activity you choose to perform.

Release. To the maximum extent permitted by law, you release NOWISLIFE and its owners, officers, and service providers from any claim for injury, illness, death, or loss arising out of your physical activity or your use of the app, except to the extent caused by our own gross negligence or willful misconduct.

Apple Health Integration

NOWISLIFE offers an optional integration with Apple HealthKit on iOS devices. When you consent and authorize access, the app may read health metrics (heart rate, steps, calories, and — to personalize coaching — resting heart rate, HRV, and sleep) and write completed workout sessions to HealthKit. To generate your coaching insights, NOWISLIFE also stores summaries of certain Apple Health data — such as your daily recovery metrics (resting heart rate, HRV, and sleep) and summaries of workouts you record outside the app — on its servers, linked to your account. This integration is for fitness tracking and personalization only — it does not constitute medical monitoring, diagnosis, or treatment. No HealthKit data — whether processed on your device or stored as one of these summaries — is ever used for advertising or data mining, sold, or shared with any independent third party for its own use, and none of it is written to iCloud by NOWISLIFE. Service providers under contract, acting solely on our behalf, are the only outside parties that process it; if you have connected Apple Health and consented, that includes the third-party AI provider that powers Coach, which receives your recovery summary only for the request it is answering. Health data is subject to the same health and assumption-of-risk terms above. You may revoke HealthKit authorization at any time through your device Settings or within the app, which also deletes these stored summaries.

Movement Sensor Data

You may optionally contribute raw Apple Watch motion-sensor data (accelerometer, gyroscope, and device-motion readings) to help improve NOWISLIFE's automatic set and rep tracking. This is separate from your Apple Watch counting reps, which works whether or not you opt in. Contribution requires your separate consent, is off by default, and can be withdrawn at any time in Settings — which also deletes the movement data you contributed. This data is stored in private cloud storage and used solely to train and improve NOWISLIFE's own tracking models; it is never used for advertising and is never sold or shared with third parties. AI-Powered Coach

NOWISLIFE includes an optional AI Coach. You can chat with Coach from within the app, and it also generates a short personalized message on your Today page. The interactive chat is powered by a third-party AI provider. To generate its responses, Coach is given your first name, facts it has saved about you (such as equipment, goals, or injuries), a summary of your routine and recent workout history, and the messages you send it — including any photos you choose to attach, which are sent to a third-party AI provider for parsing and are not stored by NOWISLIFE. The short daily Today message is generated using third-party AI providers, from a summary of your recent workout activity. No payment information, passwords, phone number, or account credentials are shared with the AI provider. Coach can propose changes to your routine or log activity, but no change to your training data is made without your explicit confirmation. If you have connected Apple Health and consented, Coach is also given your recovery summary — resting heart rate, heart-rate variability, and last night's sleep — so it can shade its suggestions for that request. Coach does save short notes about your stated equipment, injuries, and goals without a separate confirmation step; you can view and delete these at any time in Settings › Coach. Coach also keeps its own notes about your training patterns, which are not shown to you in the app but which you can erase with "Forget everything" in the same place. You can disable the daily message or clear your chat at any time in Settings.

Support AI Triage

When you submit a support ticket or contact message, the text of your message, your name, and any screenshot you attach may be processed by an AI model to generate a summary and priority assessment for our support team. This processing helps us respond faster. No payment information or passwords are ever included.

SMS Messaging

By providing your phone number during registration, you consent to receive one-time SMS verification codes from NOWISLIFE. Messages are sent via a third-party SMS provider solely for account verification — we do not send marketing or promotional messages. Message frequency is one (1) message per verification request. Push Notifications

NOWISLIFE sends push notifications for workout reminders, team activity, challenge alerts, personal milestones, and — if you use the social features — follow requests, spots, comments, copies of your workouts, and a Monday weekly recap. During a workout, an optional Live Activity shows your current exercise and set progress on your Lock Screen and Dynamic Island. You can configure which notification categories you receive in Settings, or disable push notifications entirely through your device settings.

Acceptable Use

You agree not to:

• Harass, threaten, bully, or harm other users, or post content that does so
• Post nudity, sexual content, hate speech, glorification of violence or self-harm, spam, or content that infringes someone else's rights
• Impersonate any person or organization, or claim a handle to mislead others
• Post other people's personal information, photos, or workout data without their permission
• Tag a location you were not actually at, or use location tags to track or expose another person
• Attempt to gain unauthorized access to any part of the service or its infrastructure
• Scrape, harvest, or bulk-download profiles, posts, or workouts, whether by hand or with automated tools
• Submit false or misleading information, including false reports
• Interfere with or disrupt the service
• Use the service for any unlawful purpose

We reserve the right to remove content and to restrict, suspend, or terminate accounts that violate these rules.

Community: Social Features & Content Standards

NOWISLIFE includes optional social features — a profile with a @handle, posts of your completed workouts, follows and friends, comments and "spots," gym check-ins, and a public profile page on nowislife.com. These rules apply to everything you post or share.

Who sees what. New accounts are private: people must request to follow you, and only accepted followers see friends-only content. Each post carries the audience you choose — Everyone, Friends, or Only me — and Everyone content is public: any user can see it (including in Nearby, which is based on the city of the gym or city you tagged), it appears on your public profile page and post pages on nowislife.com without an account, it can be previewed when links are shared (including the photo), and search engines may index it. A public post from a private account is still public. Individual check-ins are only ever visible to your friends; your aggregate "Top gym" stat (gym name and visit count) follows your Stats Visibility setting — Everyone, Friends, or Only me. Your stats visibility and whether you appear in Nearby are settings you control.

Copying workouts ("Run it"). Any user who can see a public workout, or a posted workout session, may copy it into their own account and use it. You can stop future copies by making a workout private or deleting a post, but copies other users already made stay in their accounts.

Zero tolerance. We have zero tolerance for objectionable content or abusive users. Objectionable content includes nudity or sexual content, harassment or bullying, hate speech, threats, glorification of violence or self-harm, spam, impersonation, and anything unlawful. Content is filtered automatically before it is shown publicly, and our team reviews reports and flagged content. We may remove content, hold it from public view, restrict features, or terminate accounts without notice, and we aim to act on reports within 24 hours.

Reporting and blocking. You can report any post, comment, or user from its ⋯ menu, and you can block or mute any user from their profile or a post; blocking removes the follow relationship both ways and hides each of you from the other across the social features (team challenges you already share are unaffected). You can also report objectionable content or abuse at nowislife.com/contact by choosing "Report Abuse / Safety."

Handles. Your @handle must not impersonate anyone or mislead others. We may reclaim or change a handle that violates these Terms, that infringes someone's rights, or that has been inactive. A handle you give up is held for 30 days before anyone else can claim it.

Location honesty. Only tag a gym or city you are actually at, and never use location tags to track, follow, or expose another person.

Map data. Gym search, place names, and city labels are provided by Google Maps Platform. By using those features you agree to be bound by the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

Team Features

When you join a team, your workout contributions, challenge completions, and aggregate progress data are visible to other members of that team.

Your Content

You retain full ownership of the content you provide — your workouts, photos, captions, comments, profile, and other data. By using NOWISLIFE you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize and re-encode, display, and distribute that content, to generate previews from it (such as workout summaries, share images, and link-preview cards), and to review it for compliance with these Terms — in each case only to operate, secure, and improve the service and only to the audience you chose (you and NOWISLIFE for private content; your team, followers, or the people you share a link with; or the public for content you set to Everyone). Deleting content ends this license for that content, except (a) copies other users already made of a public workout or posted session, which stay in their accounts, and (b) copies we retain for a limited time for backup, security, or legal reasons. We may remove content that violates these Terms.

Our Intellectual Property

NOWISLIFE owns the app, its software, design, content, and the NOWISLIFE name and logo. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose. You may not copy, modify, reverse-engineer, resell, or create derivative works from the app except as the law allows.

Feedback

If you send us ideas, suggestions, or feedback, you grant NOWISLIFE a perpetual, irrevocable, royalty-free license to use them for any purpose, with no obligation to you.

Copyright Complaints

If you believe content shared on NOWISLIFE infringes your copyright, send a notice through nowislife.com/contact that includes: the work you claim is infringed, the content at issue and where it appears, your contact information, and a statement that you have a good-faith belief the use is unauthorized. We respond consistent with the Digital Millennium Copyright Act and may remove the content and terminate repeat infringers.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless NOWISLIFE and its owners, officers, and service providers from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of: (a) content you submit, post, or share, including team posts and anything you send the AI Coach; (b) your misuse of the service; (c) your violation of these Terms or of any law; or (d) your violation of any third party's rights. We may take over the defense of any matter subject to indemnification, and you agree to cooperate.

Termination

You may delete your account at any time from within the app. We may suspend or terminate your account, or remove or restrict content, if you violate these Terms — including, without notice, for objectionable content or abusive behavior identified by our filters, by a report, or by our team. Upon deletion, your data is queued for permanent removal after a 7-day grace period; content you posted is hidden from everyone immediately.

Export Controls

You represent that you are not located in, or a resident of, any country or region subject to U.S. economic sanctions, and that you are not on any U.S. government restricted-party or sanctions list.

Arbitration & Dispute Resolution

Please read this section carefully — it affects your legal rights. This section is governed by the Federal Arbitration Act.

Informal resolution first. Before starting arbitration, you agree to contact us at nowislife.com/contact and give us 30 days to try to resolve the dispute informally.

Binding individual arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of NOWISLIFE that is not resolved informally will be settled by binding individual arbitration, not in court — except that either party may bring a qualifying claim in small claims court, and either party may seek injunctive relief in court for intellectual-property or unauthorized-access claims.

Provider and rules. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this agreement. If the AAA is unavailable, the parties will agree on another established provider, or a court will appoint one.

Delegation. The arbitrator — not any court — has exclusive authority to decide all issues about the interpretation, scope, and enforceability of this section, except that a court decides whether the class-action waiver below is enforceable.

YOU AND NOWISLIFE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR CLASS-WIDE ARBITRATION. The arbitrator may not consolidate more than one person's claims or preside over any representative proceeding.

Costs. We pay arbitration filing and administration fees to the extent required by the AAA Consumer Rules. Each party otherwise bears its own attorneys' fees, except where a statute or the arbitrator provides otherwise.

Location. Arbitration is conducted by phone or video, by written submissions, or — if the arbitrator orders an in-person hearing — in the county where you live or another mutually agreed location.

Mass arbitration. If 25 or more similar claims are filed against NOWISLIFE by or with the help of the same or coordinated counsel, the claims will be batched and resolved in staged groups, and any limitation period is tolled for claims awaiting their batch.

Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim alone proceeds in court and the rest of this section still applies to all other claims. If any other part of this section is found unenforceable, it is severed and the rest stays in force.

Opt-out: You may opt out of this arbitration agreement within 30 days of creating your account by submitting a written notice through nowislife.com/contact. Your notice must include your name and the email address associated with your account. Opting out does not affect any other part of these Terms.

Disclaimer of Warranties

NOWISLIFE is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or accurate, or that any health, fitness, or coaching information it provides is correct or suitable for you.

Limitation of Liability

To the maximum extent permitted by law, NOWISLIFE and its owners, officers, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of or inability to use the service. Our total liability for all claims relating to the service is limited to the greater of the amount you paid NOWISLIFE in the prior twelve (12) months or one hundred U.S. dollars ($100). These limits do not apply to liability that cannot be limited by law — including for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and notify you through the app. Continued use of NOWISLIFE after the effective date constitutes acceptance of the updated Terms.

Governing Law & Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The Federal Arbitration Act governs the Arbitration section. For any claim not subject to arbitration, you and NOWISLIFE agree to the exclusive jurisdiction of the state and federal courts located in New York. Nothing here removes any mandatory consumer protection of your home state that cannot be waived by agreement.

Apple App Store

NOWISLIFE is distributed through the Apple App Store, and the following apply on Apple devices:

• These Terms are between you and NOWISLIFE only, not Apple, and Apple is not responsible for the app or its content.
• NOWISLIFE grants you a limited, non-transferable license to use the app on any Apple-branded device you own or control, under the Usage Rules in Apple's Media Services Terms and Conditions.
• NOWISLIFE, not Apple, is solely responsible for the app and any maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); otherwise Apple has no warranty obligation for the app.
• NOWISLIFE, not Apple, is responsible for any claim relating to the app, including product-liability, regulatory, and intellectual-property claims.
• You must comply with applicable third-party terms (for example, your wireless carrier's terms) when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

General

These Terms and our Privacy Policy are the entire agreement between you and NOWISLIFE. If any part is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures beyond our reasonable control. The disclaimers, limitation of liability, indemnification, and arbitration sections survive termination. We may give you notice through the app or by email.
